Privacy Policy

We know that privacy policies can be a bit on the dry side and not the simplest to digest, but we have done our best to make ours cover all the necessary topics whilst being a little simpler to take in.

iFootpath takes your privacy seriously and we are committed to protecting your personal information. Please read this Privacy Policy carefully to understand how we use your personal information. The policy explains how we use the information you provide us with in order to deliver our services to you and to further our work in managing our walking guides, website and App and in making walking more accessible to everyone. This policy, along with our Terms and Conditions, shall govern your access to and use of our services.

 

Who we are

iFootpath is run by husband and wife team, Richard Jemmett and Claire Sharp, with the aim of making walking accessible, simple and fun to everyone. Being careful, clear and straight-forward is at the heart of everything we do, when it comes to guiding you around our walks or when it comes to handling your information. We keep our promises and that includes treating your personal information with care. iFootpath is a trading name of OneToRemember LLP (registered partnership number OC386273).

 

Your information – what the law says


The Law on Data Protection is most recently covered by the General Data Protection Regulation (GDPR) which is enforceable from May 2018. The GDPR states that personal data (information relating to a person that can be individually identified) can only be processed if there is a legal ground to do so. Activities like collecting, storing and using personal information would fall into the GDPR’s definition of processing. The GDPR provides six legal grounds (reasons) under which personal information can be processed (used) in a way that is lawful. For the processing to be lawful, at least one of the legal grounds must apply. The legal grounds that are most relevant to iFootpath’s use of your personal information are:
 
  • Contract – As part of the purchase of and registration within the iFootpath App (or registration on the iFootpath website), we have a contract with you, that we can only fulfil by using your personal information (e.g. by sending registration confirmation emails, by storing the walking information and tags you create within our systems).
  • Legitimate Interest – We will send monthly customer newsletter emails in order to support our business purposes and societal benefits. Our business purposes include keeping our customers informed of latest content/features, improving customer satisfaction and driving the growth of iFootpath. The societal benefits include sharing public health, walking safety and walking accessibility information. Our use will be fair and balanced and will never unduly have an impact on your rights. You have the ability to opt out of these newsletters at any time by clicking on the Unsubscribe link in your Welcome Email or any of the newsletter emails.

 

Your Information – what we collect and how we use it


iFootpath only collects the information that we need to deliver our customised and tailored digital walking guides service to customers:
 
  • When customers register to use our website and/or App, we collect a Name, Username, Email Address and Password. We use this information to ensure individual customers have a profile, can download selected walking guides to their own device and can tag walks as ‘favourites’ or ‘completed’ and access these lists across all platforms and devices. We may use this information to contact you regarding system information (including sending username reminder or password reset emails when requested).
  • We do NOT collect any payment information or address information – all payments for the App are processed independently of iFootpath, via the Amazon, Apple or Google App Stores. You should check these organisations’ own privacy statements to understand how their App Store privacy is handled. Any customer donations made to iFootpath are collected via Paypal and no payment information is stored by iFootpath from this transaction.
  • When you log-in and interact with our App or website, we collect the Walk Comments posted, the Gallery Photographs submitted, lists of Walk Names that have been downloaded or tagged as favourite/completed, the GPX files uploaded and Walking Guides submitted. It is also necessary to collect and record the physical location of your mobile device to enable you to navigate using the App’s live GPS map or to track your own GPS routes. We use this information to deliver the service you have signed up to, to keep our walking guides up to date, for the purpose of understanding your needs and providing better services to all of our website and App users. Your Photos and Comments display publicly on the website and App alongside your Username (or Display Name) only, we do not display personal Email Addresses.
  • If you contact us (for example, if you have a query or problem with our website or App), we may keep a record of that correspondence on our Help Centre
  • We will contact you via email (on the grounds of Legitimate Interest described above) with information on system support, walking news and updates about our services and content via our Monthly Customer Newsletter email. You can change your preferences on whether you wish to receive these updates at any time, either by clicking the unsubscribe button at the bottom of the email, by logging in to your account and changing your preferences, or by contacting us (via email or our online help system).
  • Some emails we send we can track, at an individual level, whether the user has opened and clicked on the email. We do not use this information at a personal level, rather we use it to understand open and click rates of our emails to try and improve them. If you want to be sure that none of your email activity is tracked, then you should opt out of our emails which you can do via the unsubscribe link at the bottom of every email we send.
  • We may also collect other non-personally identifiable information each time you visit our website, including the anonymised IP address used to connect your computer to the internet, browser type and version, device type and screen size and length of visit.

 

Your information – how we store and share it


We are committed to ensure that your information is held securely:
  • In order to prevent unauthorised access or disclosure, we use Security Sockets Layer (SSL) encryption technology to encrypt sensitive information (i.e. passwords).
  • We follow generally accepted standards to protect your data from cross-site scripting (XSS) vulnerabilities.
  • We use a managed security service provider, a cloud-based platform providing website security, anti-virus and firewall, to protect your data from unauthorised access.

 

In terms of sharing personal information:


  • We will not sell, share or swap your data with any third parties.
  • We may sometimes share your information with our trusted service providers (including our technology developers and server hosting company) who work on our behalf to keep our systems robust and secure. This access is only granted to the extent necessary for them to perform their services for us.
  • We may also disclose your personal information to third parties:
    • if we sell the ownership of our company, business or assets, or, buy any business or assets, in which case we may disclose your personal information, on confidential basis, to the prospective buyer or seller, respectively; in which case we will give the affected users notice before any personal information is transferred (or becomes subject to a different privacy policy);
    • if we are under a duty to disclose your personal information in order to comply with a legal obligation, or to satisfy any applicable law, regulation, legal process or to satisfy an enforceable governmental request, or to defend ourselves against third-party claims or allegations, or to detect, prevent, or otherwise address fraud.

 

Your information – how to access and update it


When a customer uses the iFootpath website and App, we make good faith efforts to provide that customer with easy access to his or her personal information:
  • When you log in to the website and/or App, you will see details of the Comments, Photos and GPX Files you have uploaded in to the iFootpath systems, as well as your username and registered email address.
  • You may contact us at any time to request that your personal data is corrected if it is inaccurate, or to request that your data is deleted, provided that it is not otherwise required to be retained by law, or for legitimate business purposes. We do, however, ask customers to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes for the last 30 days).

 

Privacy of Children


iFootpath is not directed at, targeted at or intended for the use of children under the age of 13. For that reason, we do not knowingly collect or hold any personal information of children under the age of 13. Our Terms and Conditions clearly state that a person must be over the age of 13 in order to create an account with iFootpath. If we learn that someone under the age of 13 has provided personal information, we will use reasonable efforts to remove such information from our records. If you have reason to believe that a child under the age of 13 has provided personal data to us, please contact us, and we will endeavour to delete that information from our databases.

We use cookies to help us to improve our website, App and services and to measure how people are using our website and App. All of these are aimed at delivering customers a better and more personalised service. First Party Cookies…


We use Google Analytics to collect information about visitor behaviour on our website. Google Analytics stores information about what pages you visit, how long you are on the site, your anonymised IP address, how you got here and what you click on. This analytics data is collected via a JavaScript tag in the pages of our site and is not tied to personally identifiable information. This information cannot be used to identify who you are.

We may also, from time to time, use the capabilities and services of Matomo Analytics, a built-in analytics platform that gives insight about how our website and App are performing.
